The Finance Act for 2025 had not yet been promulgated when the Paris Council adopted an increase in the rate of the departmental tax from 4.5% to 5% for the calculation of the transfer tax (DMTO) applicable to the sale of buildings completed more than five years ago. Côte-d'Or, Ille-et-Vilaine, Loire-Atlantique, Maine-et-Loire and Rhône have followed suit! Other départements will follow. It should be remembered that the Finance Act authorizes the Départements to temporarily increase the rate of sales tax they levy for sales between April1, 2025 and March 31, 2028. This increase does not apply to first-time buyers. Once the decision has been taken, the deliberation must be notified by the Departmental Council to the tax authorities, and it is the date of this notification that determines the effective date of the increase.
